Terms and conditions

General

This contract incorporates these terms and conditions, which shall prevail over any other terms and conditions. Kisasa Designs Ltd reserves the right to change and amend these terms and conditions. You are responsible for reading the terms and conditions. Any payment made to Kisasa Designs Ltd constitutes that you have read and agreed to these terms and conditions.

Price and Payment Terms

All products and prices are subject to availability. Prices are provided in dollars (USD) or Tanzanian Shillings (TSH) and are subject to change without notice. 

Kisasa Designs Ltd has a policy of continuous product development and reserves the right to amend the specifications of products. Products supplied may differ from those on display or advertised. Unless previously agreed upon, the products supplied will be of equivalent value, functionality and appearance. Prices do not include delivery. 

Custom Order Estimates and Invoice Payment Terms 

Customers ordering custom furniture or decor will be provided with an Estimate which will specify a price for each item in the order and an expiration date. Prices provided on the Estimate are only guaranteed until the expiration date on the Estimate. 

If an Estimate is approved by the customer, an Invoice will be provided that matches the prices on the Estimate. It is the customer’s responsibility to pay the deposit on the invoice by the due date specified on the invoice. Should the customer fail to pay the deposit within that period, the price is subject to change. 

Payment terms are as follows unless specified otherwise on the invoice: 70% of price is due upon receipt of invoice and 30% remaining balance is due within 5 days of delivery of the order. Deposits are nonrefundable. 

Overdue balances are subject to a 2% monthly finance charge until payment is received in full.

Limited Warranty / Liability 

Kisasa Designs Ltd warrants its products against defects in manufacturing and workmanship for a period of six (6) months from date of purchase, provided the product was used under normal conditions and was used for the purposes for which it was designed. Warranty does not include wear and tear. It is required that Kisasa Designs Ltd receives digital images of manufacturing damages before replacement shipments will be processed. Kisasa Designs Ltd requires return of defective items if replacements are provided. 

The warranty is to the initial purchaser and is valid while they own the merchandise. No other warranty, including warranty of merchantability and fitness, for any particular purpose will be made by Kisasa Designs Ltd either expressed or implied. Kisasa Designs Ltd will not be liable for incidental or consequential damages arising from any product defect. 

Once you have notified Kisasa Designs Ltd of a problem with the goods, we will replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid for the goods in question. Kisasa Designs Ltd will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods. Kisasa Designs Ltd shall have no liability to pay any money to you by way of compensation other than any refund made under these conditions. 

Return Policy 

In the event that the customer is not satisfied with their purchase, they must provide written notice to Kisasa Designs Ltd within 7 days of receipt of the item in order for a return or replacement to be considered. All complaints about satisfaction will be evaluated on a case by case basis. 

Materials and Finishes 

Kisasa Designs Ltd incorporates natural materials into its products. The natural beauty of the wood results in random variation in color and pattern. This variation is an integral part of the appearance of the furniture and is to be expected. In addition, the finishes are subject to color change depending on age and exposure to light. Kisasa Designs Ltd specializes in hand-crafted furniture and decor therefore some variation in products is to be expected. 

Production Timeline 

Because custom furniture and decor are made to order, the production timeline will be estimated and communicated to the customer at the time of issuing the invoice. We make every effort to deliver items on time according to the production schedule, however, if delays occur they will be communicated to the customer with as much advanced notice as possible. 

Events Beyond Our Control 

Kisasa Designs Ltd shall have no liability to you for any delay or failure to deliver goods you have ordered or for any damage or defect to goods delivered that is caused by any event or circumstance beyond reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or any other natural disaster or accident. 

Indemnification 

You agree to defend, indemnify and hold Kisasa Designs Ltd harmless from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your breach of these Terms of Use. 

Invalidity 

If any part of these terms and conditions is unenforceable (including any provision in which we exclude Kisasa Designs Ltd’s liability to you) the enforceability of any other part of these conditions will not be affected.
